Leicester win appeal against decision over Premier League’s PSR breach

Leicester have won an appeal that stopped them from losing points for breaking Premier League profit and sustainability rules (PSR).

An independent panel said the Premier League couldn’t punish Leicester because they weren’t in the Premier League during the accounting period under review.

The club had been relegated to the EFL Championship when their accounting period ended on 30 June 2023.

Leicester ceased to be a Premier League member from 14 June in 2023 – 16 days before they closed their accounts.

However, The Premier League said it was “surprised and disappointed” by this decision.

Leicester argued that the rules should be followed exactly as “they are actually written”. They believed they shouldn’t be punished because they were in the Championship when the issue was raised.

The Premier League accused Leicester of spending too much over three seasons, which is against the rules. Under PSR rules, clubs cannot lose beyond £105m over a three-season spell.

This means the club was charged by the Premier League with breaching spending rules.

Leicester appeal against decision that they breached PSR

The Foxes tendered an appeal against the PL’s charge but an independent commission reached a decision that the league could take action.

Leicester then appealed against that decision because they were no longer in the Premier League when the accounts were filed. The outcome of the latest independent panel was announced on Tuesday.

Everton and Nottingham Forest were victims of points deductions last season after both cubs were found to have breached PSR rules.

In its ruling, the independent panel said the PSR rules “are, in relevant parts, far from well drafted”.

In its reaction to the ruling, the Premier League added: “If the appeal board is correct, its decision will have created a situation where any club exceeding the PSR threshold could avoid accountability in these specific circumstances.

“This is clearly not the intention of the rules.”

The panel supported Leicester’s appeal stating the outfit was “no longer a club” governed by the profit and sustainability rules (PSR) when the calculation was executed.
