Court gives DSS 7 days to charge or release Emefiele 

A Federal High Court sitting in Abuja has given the Department of the State Security Service (DSS) a one-week ultimatum to charge the embattled Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele to Court or set him free.

Justice Hamza Muazu gave the order while delivering a ruling on the fundamental human rights suit Emefiele filed to challenge his arrest and detention by the DSS and others.

According to the Judge, the suspended CBN Governor hasn’t shown that his arrest and investigation are unlawful but has the right to get a fair hearing.

Justice Muazu said Emefiele can’t remain in detention without a formal charge, saying  DSS can’t use the period of Emefiele’s detention to search for evidence against him.

He maintained that DSS has power to carry out its constitutional duties of detaining, and ensuring prevention of internal crime but must be carried out within the law

Recall that the suspended CBN governor sued the Attorney General of the Federation, Director General of the DSS to seek enforcement of his fundamental human rights to freedom of movement and dignity to human life.

According to the suit, Emefiele applied that his arrest and detention since June 10 without valid order of court be voided and nullified as well as asked for a compensation of N5 million as exemplary damages for his detention.

NRTC earlier reported that President Bola Tinubu suspended Emefiele as CBN governor on 9th June and was arrested by DSS in the early hours of June 10 at his Ikoyi, Lagos home — has been in detention since then.
